CONDITIONS OF REGISTRY AND WARNING
1. RULES FOR REGISTRATION
All Wyoming-Bred Horses must be registered with the Wyoming All Breeds Racing Association to be eligible for Breeder Awards.
2. WYOMING BRED DEFINED
(A) A "Wyoming Bred" horse is a horse foaled in the state of Wyoming, out of a mare that has been registered as an accredited Wyoming broodmare.
(B) A "Wyoming broodmare" is a mare permanently domiciled in the state of Wyoming except for medical, racing and breeding purposes and registered with the American Quarter Horse Association, the American Paint Horse Association, the Appaloosa Horse Congress, or the Jockey Club and accredited by the state breed organization recognized by the commission.
3. APPLICANTS RESPONSIBILITY
The applicant on behalf of himself and successors and assigns assumes full responsibility for proper identification of the horse as being Wyoming-Bred; and agrees that if it should later be provided ineligible, all monies won in Wyoming-Bred races and all breeders' awards shall be forfeited; and agrees to repay monies on demands by the Wyoming All Breeds Racing Association.
4. Controversies shall be decided by the Wyoming All Breeds Racing Association Board of Directors. The applicant and successors or assigns agree that any and all controversies regarding eligibility of the horse under the Wyoming-Bred rule and the Rules of the Wyoming All Breeds Racing Association shall be decided by the Board of Directors after a hearing convened for the purpose of hearing the views of all interested persons concerning eligibility of the horse or other matters.
5. The decision of the Board of Directors is final and binding upon the parties. The applicant and successors or assigns respectively waive their right to seek remedies in court, including the right to jury trial. All questions of law and procedure shall be determined by Wyoming Law and its provisions, or the duly adopted Rules of the Wyoming All Breeds Racing Association.
6. Transfers of horses registered in the Wyoming-Bred Registry are expressly conditioned upon and made subject to these Conditions of Registry and Warning, which are binding upon successors of the original applicant or his assigns.
7. TRANSFER OF OWNERSHIP REQUIRED
Notification of sale or transfer after a horse has been registered must be made to the Wyoming-Bred Registry as soon as possible. All sales of horses registered in the Wyoming-Bred Registry are made subject to the conditions and requirements of the Conditions of Registry and Warning herein and Rules of the Wyoming All Breeds Racing Association in effect from time to time as provided in Section 16 thereof.
8. SANCTIONS FOR VIOLATION OF RULES, CONDITIONS AND WARNINGS
Applicant and successors and assigns are hereby apprised concerning, and do hereby acknowledge, that in addition to other penalties involving forfeiture of monies won and breeder's awards, the Board of Directors may suspend and expel persons for reasonable causes including, but not limited to, violation of Association Rules and for conduct prejudicial to the best interest of the Association, all as provided in Paragraph 3 of the Rules.
